GENERAL TERMS AND CONDITIONS OF SALE

TABULA offers an online sales service with delivery throughout Italy and worldwide, governed by the following general terms and conditions of sale. By placing an online order, you agree to accept these terms and conditions in full.

ORDERS

All items featured on the TABULA website are available in our online shop, which can be accessed via the dedicated section on the home page. All items are grouped by category, or can be easily found using the search bar at the top right of the home page. Each item is displayed with a preview image, the price (including VAT) and a brief description. By clicking the ‘Add to basket’ button, the product will be automatically added to your basket, which can be viewed at the top right of every page.

DELIVERY

Orders received by 12.00 pm will be processed immediately.
EXPRESS delivery is expected within 24–48 working hours of the order being processed.
STANDARD delivery is expected within 4–5 working days of the order being processed.
Delivery times apply to products in stock.
For other products, the delivery date will be communicated by email and/or telephone.

ORDER CONFIRMATION

Every order received will be confirmed to the customer by email.

SHIPPING COSTS

TABULA uses the domestic and international postal services of Poste Italiane. Once we receive your order, it will be processed within the following 7 working days and delivered to you within the timeframes indicated above: 3–5 days for Europe and 5–7 days for the rest of the world, following dispatch, subject to customs checks.
For the processing of bulkier items, such as paintings, etc., TABULA reserves the right to apply a surcharge to be determined based on the dimensions, weight and chosen destination country.

PAYMENTS

Payments are made via:

Bank transfer in advance, upon goods being ready

By bank transfer, specifying the order number issued by the system in the payment reference.
Only payments made from bank accounts held in the name of the person placing the order will be accepted.

By accepting the terms and conditions of sale and clicking on the ‘Buy’ button, the buyer STRICTLY undertakes to make payment by bank transfer within 3 days, failing which the order will be cancelled.

Credit to PayPal account

You will be provided with the delivery details by clicking on the ‘Complete Order’ button in the ‘YOUR BASKET’ section and logging in to PayPal. Once payment has been made, you will be asked to enter your delivery address.
Other payment methods will be agreed in advance, subject to authorisation.

REFUNDS

Online sales are governed by Legislative Decree No. 185 of 22 May 1999, which regulates distance contracts, i.e. those concluded outside business premises. This legislation establishes the right of withdrawal, which is the consumer’s right to return the purchased product and obtain a refund of the cost incurred.
The legislative decree does not apply to persons who cannot be classified as consumers, namely those acting for purposes related to any professional activity they may carry out, i.e. those who place an order and provide a VAT number for the invoice.
The Customer has the right to cancel the order, without incurring any penalty and without having to give a reason, within 10 working days of delivery (the delivery date shown on the courier’s waybill shall be taken as proof).
The right of withdrawal must be exercised within the specified time limit by sending a registered letter with acknowledgement of receipt, together with all the goods purchased, to the following address: TABULA, Supportico Marina Piccola, 9, Amalfi (SA). Notice may also be given in advance by email.
Where the right of withdrawal applies, the Customer is required to return, at their own expense, all items listed on the invoice in the condition in which they were received, i.e. brand new, unused, complete with all parts and in their original packaging (envelopes and boxes).
Failure to comply with these conditions renders the right of withdrawal inapplicable. Where the right of withdrawal applies, once the goods have been received, TABULA will refund the full amount paid by the customer, excluding shipping costs, within thirty days of the date on which the notification was received, via the following methods:
an exchange of goods, a bank transfer.

Please note: If the right of withdrawal does not apply, the Customer shall be responsible for collecting the goods from our premises
SUPPLIER’S WITHDRAWAL.
Should TABULA be unable to fulfil the order due to the unavailability – even temporary – of the product ordered, it reserves the right to withdraw from the sales agreement within 30 days of the order date by providing the customer with a simple written notice stating the reasons, in accordance with Article 6(2) of Legislative Decree 185/99. In such cases, the customer shall be entitled solely to a refund of any amount already paid.

Upon receipt of the goods, the Customer must check that the packages are intact and that the correct number has been delivered. In the event of any discrepancies, the Customer must sign the delivery note “subject to inspection”, stating the reason (e.g. severely damaged package or missing package), and send an email to our customer service department within 24 hours of receiving the goods.
In the event of a replacement due to goods not complying with the order, notification must always be sent to TABULA at Supportico Marina Piccola, 9, within 5 days of the invoice date.
Our customer service team will provide you with a returns authorisation number, which must be written both on the outside of the return parcel and on the delivery note.
Our customer service team will also send the customer a form containing the following information:
Return authorisation number
Sender: Customer’s first name, surname and address
Recipient: first name, surname and address
Carrier: Courier collecting the parcel
Reason for dispatch: replacement or return of goods.

WARRANTY

Purchasing goods from TABULA implies full acceptance of the manufacturer’s warranty terms, which may be independent of TABULA’s own policies.
The customer is therefore aware that the goods purchased will be covered by the manufacturer’s warranty, subject to the terms and conditions set out by the manufacturer.

SOCIAL RESPONSIBILITY

TABULA complies with current regulatory and legislative provisions regarding social responsibility. In the case of website users who are minors or belong to vulnerable groups, those with parental authority or legal responsibility for them may exercise their right of withdrawal in accordance with current regulations.

PRIVACY

Pursuant to Article 13 of Legislative Decree 196/2003 and the various new legislative provisions, including Articles 13 and 14 of Regulation (EU) 2016/679, TABULA will process the data you have provided in compliance with the legislation governing the protection of personal data.
The provision of data is optional; however, any refusal to provide such data will make it impossible to fulfil the obligations arising from the contract to which you are a party.
The personal data you provide is collected electronically and processed, including by electronic means, directly and/or through authorised third parties for the following purposes:

  • purposes relating to the provision of the service and the processing of product purchase orders;
  • statistical purposes, sending promotional material, including via email.

In the context of administrative, accounting, tax, logistical and marketing activities, it is sometimes necessary to disclose certain processed data (e.g. to banks, accountants, external consultants, public authorities, home delivery companies and outsourcing providers).
A list of these parties is available at our offices. TABULA undertakes not to disclose or disseminate any information concerning you for commercial purposes, and not to sell, share or transfer its databases.
Within TABULA’s offices, your data may only be accessed by specifically authorised personnel working in the IT, Marketing, Administration and Accounting, and Customer Service departments.
Pursuant to Article 7 of Legislative Decree 196/2003, you have the right at any time to obtain, from the Data Controller, information regarding the processing of your data, the methods and purposes thereof, and the logic applied to it, as well as:

  1. Confirmation of the existence of the data and disclosure of the data and their source;
  2. The identification details of the Data Controller and Data Processors, as well as the persons or categories of persons to whom the data may be disclosed or who may become aware of it in their capacity as Data Processors or persons authorised to process the data;
  3. The updating, correction and supplementation of data;
  4. The erasure, anonymisation or blocking of data processed in breach of the law;
  5. Confirmation that the actions referred to in points 3) and 4) have been brought to the attention of those to whom the data have been disclosed and disseminated, except where this proves impossible or involves a clearly disproportionate effort in relation to the right being protected;
  6. To object: to the processing of data, even if relevant to the purpose for which it was collected, on legitimate grounds; to the processing of data for commercial information purposes or for the purposes of market research.

All personal data collected by TABULA will be managed and processed in accordance with current legislation and as specified in our Privacy Policy, which can also be accessed by clicking on the relevant link on every page of the website.

TERMS AND CONDITIONS

The terms and conditions set out in this document may be amended without prior notice and shall take effect from the date of publication on the website.

COMPETENT COURT

In the case of Italian consumers, Italian law applies; as regards the competent court, in accordance with the provisions of Article 12 of Legislative Decree No. 50 of 1992 and Article 14 of Legislative Decree No. 185 of 1999, the court of the consumer’s place of residence or domicile shall always have jurisdiction; any provision to the contrary shall be deemed an unfair term and shall not apply.
In the case of foreign consumers, the parties are free to choose which law applies (Italian law or the law of the consumer’s country), provided that the principle that minimum guarantees cannot be waived is upheld and, in any event, the law most favourable to the consumer applies.
